Hayes Apartments Lifestyle Discount Card Scheme terms & conditions

These terms and conditions (the “Terms”) govern your participation in the Hayes Apartments Lifestyle Discount Card Scheme (the “Scheme”) and your relationship with the Promoter (as defined in paragraph 21 below). You should read these terms carefully before deciding whether to take part in the Scheme. If you use a Hayes Apartments Lifestyle Discount Card or apply to take part in the Scheme, you will be taken to have agreed to these Terms. Please print and retain a copy of these Terms for your reference.

1 Subject to these Terms, the Hayes Apartments Lifestyle Discount Card entitles you to discounts or other offers from shops and restaurants in the St David’s Shopping Centre and certain other parts of Cardiff city centre that are participating in the Scheme.

Eligibility

2 To be eligible for a Hayes Apartments Lifestyle Discount Card, applicants must provide evidence acceptable to the Promoter that they live in the Hayes Apartments. The Promoter will issue the Hayes Apartments Lifestyle Discount Card at its discretion and may decline an application or refuse to reissue an expired card for any reason. The Promoter’s decision is final.

3 If you cease to live in the Hayes Apartments you will no longer be entitled take part in the Scheme and you must return your Hayes Apartments Lifestyle Discount Card to the Hayes Marketing Suite on the Upper Level of the St David’s Shopping Centre or send it to the address set out in paragraph 23 below.

4 To participate in the Scheme and to take advantage of the Hayes Apartments Lifestyle Discount Card you must be aged 16 or over.

5 Your Hayes Apartments Lifestyle Discount Card is personal to you and may only be used by the person whose signature is on the card. It may not be sold, given or loaned to anyone else to use. The Hayes Apartments Lifestyle Discount Card has no cash redemption value.

Participating shops and restaurants

6 A list of participating shops and restaurants is published in the Hayes Update Newsletter and on the Hayes website www.hayesapartments.co.uk. Hard copies may also be obtained from the Hayes Marketing Suite on the Upper Level of the St David’s Shopping Centre. The Promoter reserves the right to amend the list of participating shops and restaurants at any time.

7 The discounts and offers available will be at the discretion of the applicable shops and restaurants and are not administered or determined by the Promoter. The Promoter will not be responsible or held liable for any products, services, offers or discounts offered or sold by participating shops and restaurants.

8 All discounts and offers will be subject to the applicable shop or restaurant’s own terms and conditions. Any queries or questions regarding a particular discount or offer should be addressed to the relevant shop or restaurant.

9 Each participating shop and restaurant reserves the right to change their offer or withdraw from the Scheme at any time.

10 Unless otherwise stated, discounts and offers only apply to full price merchandise and may not be used in conjunction with any other offer.

Using your Lifestyle Discount Card

11 To claim your discount or other offer, you must show your Hayes Apartments Lifestyle Discount Card together with proof of residence at the till-point of the participating shop when making your purchase or on arrival at a participating restaurant.

12 Your Hayes Apartments Lifestyle Discount Card may display an expiry date. You must not use your card after this expiry date. If your Hayes Apartments Lifestyle Discount Card expires and you do not receive a replacement card, please contact the Hayes Marketing Suite on the Upper Level of the St David’s Shopping Centre.

13 Unless otherwise permitted by the applicable retailers or restaurants in their absolute discretion, discounts and offers available as part of the Scheme may only be used in the participating shops and restaurants in the St David’s Shopping Centre and certain other parts of Cardiff city centre and cannot be used in shops and restaurants in other locations or for website purchases.

14 The Hayes Apartments Lifestyle Discount Card will remain the property of the Promoter at all times and must be returned to the Hayes Marketing Suite on the Upper Level of the St David’s Shopping Centre or destroyed upon request from the Promoter.

Changes to the Scheme

15 The Promoter reserves the right at any time to:

(i) alter these Terms; or

(ii) withdraw the Scheme and/or an individual’s Hayes Apartments Lifestyle Discount Card.

16 The Promoter may take any action it considers appropriate, including withdrawing an individual’s Hayes Apartments Lifestyle Discount Card, if it has reason to believe that an individual is abusing the Scheme or is in breach of these Terms.

Use of your personal data.

17 These Terms and the Promoter’s Privacy Policy, a copy of which can be found at www.hayesapartments.co.uk, govern the Promoter’s use of any personal data collected from you by the Promoter in relation to the Scheme.

18 The Promoter may use your personal data to contact you via post or email in relation to the Scheme. This may include notifying you of changes to these Terms and providing you with details of the shops and restaurants participating in the Scheme and their offers.

19 By applying to participate in the Scheme you also consent to the Promoter contacting you to tell you about any events, promotions and activities taking place at the St David’s Shopping Centre. You may opt out of receiving such communications at any time by following the instructions in the communications.

20 The Promoter will not pass on your personal information to third parties except as may be required for the purposes of administering the Scheme.

21 The Hayes Apartments Lifestyle Discount Card is promoted by St David's (Cardiff Residential) Limited (Company number 6531995) in conjunction with St David's (No.1) Limited (Company number 4765790) and St David's (No.2) Limited (Company number. 4765790). The registered office for each of these companies is at 5 Strand London WC2N 5AF.
